Terms and conditions
The offer and sale of products on the www.lepiantagionidelcaffe.it/shop website, owned by Le Piantagioni del Caffè S.r.l., are governed by the following General Conditions of Sale.
The General Conditions of Sale are prepared in accordance with Italian Legislative Decree no. 206 of 6 September 2005 (Italian Consumer Code), and all other applicable laws on the topic.
Le Piantagioni del Caffè S.r.l., with registered office in Livorno, Via Provinciale Pisana 583/B, Livorno Chamber of Commerce Register of Companies, Tax Code and VAT no. 01579870492 (hereinafter Le Piantagioni del Caffè) offers its products for sale on the www.lepiantagionidelcaffe.it/shop website and carries out e-commerce activities targeted exclusively at end users, understood to mean end consumers or natural persons acting outside the scope of their business and professional activities, identified via the www.lepiantagionidelcaffe.it/shop website (hereinafter the Customer). In view of our commercial policy, we reserve the right not to process orders from persons other than a Consumer or any orders that do not comply with our commercial policy as referred to above.
For logistical reasons, Le Piantagioni del Caffè sells its products through the www.lepiantagionidelcaffe.it/shop website only and exclusively to customers in the Italian Republic, the Republic of San Marino and Vatican City. Purchase requests that specify a delivery address outside of Italy cannot be accepted or processed by Le Piantagioni del Caffè.
By placing an order using the methods made available, the Customer declares that they have taken note of all instructions provided during the purchasing process and accept all General Conditions of Sale. Le Piantagioni del Caffè reserves the right to change the General Conditions of Sale by providing notice on this website. The applicable General Conditions of Sale are those in force at the time the order is placed. All changes made will come into effect once they are published on the site.
Registering with the site
Registering with a username and password is optional. Customers who do not wish to register can still place an order and will only be asked for the details required to deliver the order and issue an invoice, where applicable.
CHARACTERISTICS AND PRICES OF THE PRODUCTS OR SERVICES
Images of products may not perfectly correspond to their characteristics and may differ in terms of colour, size or additional products shown.
All information provided to support the purchasing process must be understood to constitute generic informational material that does not represent the actual characteristics of an individual product.
Products are offered at the price indicated on the site on the date the order is placed. Prices include VAT, the amount of which will be listed separately on the product purchase invoice.
Prices do not include transport and delivery costs, which are indicated in the final section before the order is submitted and specified in the order receipt confirmation e-mail sent to the Customer.
Minimum or maximum order quantities apply and products are offered within the limits of stock availability.
Orders placed by minors will not be accepted.
The various stages of placing the order and entering into the sales contract are clearly identified through text and informational graphics on the pages of the website that appear in sequence.
Once payment has been confirmed, the order can no longer be cancelled or changed.
Any promotional codes made available by Le Piantagioni del Caffè and its partners are only valid for the products and the period specified on each individual occasion. Promotional codes cannot be exchanged for cash and are not cumulative. To use the discounts and/or offers associated with the promotional codes, enter the promotional code in the appropriate space when confirming an order on the site. If the Customer forgets to use a code, the order cannot be cancelled or resubmitted to add the promotional code.
Receipt confirmation and acceptance of an order
Once an order is received, Le Piantagioni del Caffè will send an automatic confirmation e-mail containing all the details of that order. Having received the order, Le Piantagioni del Caffè will check the availability of the ordered product. Once it confirms that the product is available, it will notify the Customer that the order has been accepted and provide shipping information.
If Le Piantagioni del Caffè is not able to process an order received, it will notify the Customer as soon as possible.
The Customer shall have no right to indemnification or compensation for damage, and no contractual or non-contractual liability will apply for direct or indirect damage to persons and/or property caused by failure to accept an order.
Accepted payment methods
Le Piantagioni del Caffè only accepts the following payment methods:
- Credit Card (American Express, Visa or Mastercard), via the Cartasi S.p.A. payment platform. The total order amount will be charged at the time the products are shipped.
- PayPal: online payment system that allows any company or consumer with an e-mail address to register and to send and receive payments. Payment is made via the PayPal payment platform.
- Advance bank transfer: to the Le Piantagioni del Caffè current account.
- Cash on delivery: payment in cash to the express courier at the time of delivery.
Shipping the products
Le Piantagioni del Caffè will only ship the purchased products to the address specified in the order. It is not possible to ship to P.O. Boxes.
Le Piantagioni del Caffè will ship the products ordered by the Customer, by courier, to the address specified by the same, generally within 48 working hours of accepting the order. Products will be delivered within 5 working days. The estimated delivery date is purely indicative.
Delivery costs are charged based on the rates specified on the site on the date the order is placed.
The recipient of the goods is responsible for paying any taxes and customs charges required under the legislation of the country to which the products are sent.
The courier is responsible for the delivery. Le Piantagioni del Caffè undertakes to receive any reports of failed or delayed delivery of products ordered through its site and, where appropriate, will support the Customer in exercising their legal rights.
Acceptance of the product by the customer
Any damage to the packaging and/or the products, mismatched number of packages or incorrect information must be immediately reported, noting the information on the delivery document. By signing the courier’s document, the Customer confirms that the outer packaging of the product is intact, and the delivery meets the relevant standards.
Any issues concerning the physical integrity, correspondence to specifications or completeness of the products received must be reported within 10 working days of delivery by e-mailing firstname.lastname@example.org or phoning 0586 429094.
Private Customers who enter their tax code will be issued an invoice for each order. The information provided by the Customer at the time of placing the order will be used to issue the invoice. It will not be possible to make changes to an invoice once it has been issued. If the shipping address differs from the invoicing address, this must be specified when placing the order. If a private Customer chooses not to enter their tax code, Le Piantagioni del Caffè will not issue an invoice or certify payment by issuing a sales receipt or fiscal receipt (Art. 22, par. 1 of Italian Presidential Decree 633/72 and Art. 2, lett. oo of Italian Presidential Decree 696/96).
Right to withdraw and rules on returns
In application of Italian Legislative Decree no. 21 of 21 February 2014 implementing Directive 2011/83/EU on consumer rights, the Customer can return the product purchased and receive a refund of the amount actually paid.
The right to withdraw can be exercised within 14 days of receiving the product by following these steps:
The Customer must send a registered letter with return receipt to Le Piantagioni del Caffè or send a similar express declaration within the 14-day time period.
Notice can be given, within that same time period, by telegram or e-mail to email@example.com, or over the phone by calling 0586 429094.
The Customer will then be contacted by Le Piantagioni del Caffè to arrange collection of the goods to be returned.
Return of the product must take place within 14 days of receipt of the withdrawal notice.
The refund of the amount paid for the product will include shipping costs.
In the event that, for reasons attributable to the Customer, the value of the products is diminished due to handling beyond what is necessary to establish the nature, characteristics and functioning of the products (e.g. if products are damaged, not packaged properly or fully, or if certain parts are missing or damaged, such as components, elements, accessories, packaging materials, boxes, documentation and/or other objects), Le Piantagioni del Caffè will deduct an appropriate amount to cover the diminished value from the refund amount. If the Customer sends the products back after the time period set out above, or if products have been opened and/or partially used and are not eligible to be returned, the right to withdraw will not apply and Le Piantagioni del Caffè will arrange to return the purchased product to the Customer, charging the latter for the shipping costs.
Within the limits set out above, Le Piantagioni del Caffè will refund the Customer the amount effectively paid within 14 days of receipt of the notice of withdrawal by crediting their current account, Paypal account, credit card or by cheque.
All products, with the exception of food products, sold by Le Piantagioni del Caffè are covered by the standard manufacturer’s guarantee and a 24-month conformity guarantee under Italian Legislative Decree 24/2002 and subsequent amendments and Articles 130 and 132 of Italian Legislative Decree 206/2005. To avail of the guarantee, the Customer must keep the invoice or, if no invoice has been issued, the transport document.
In the event of manufacturing defects and/or if the product purchased has been damaged during transport, the Customer can request replacement of the same no later than 10 days after receiving it by telegram or e-mail to firstname.lastname@example.org, or by phoning 0586 429094. The Customer must also return the defective or damaged product in its original packaging, with all parts intact.
In the event of replacing the product, Le Piantagioni del Caffè will cover the shipping costs for the return. Le Piantagioni del Caffè will arrange to replace the product with another identical product or, if that product is out of stock, and in agreement with the Customer, with another product of equivalent value.
Applicable law and jurisdiction
The sale of products and/or supply of services will take place within Italy and is subject to Italian law. In the event of any disputes, the jurisdiction provided for by Italian law at the time of entering into the contract shall apply.
