Terms and conditions
The offer and sale of products through the website www.lepiantagionidelcaffe.it/shop, owned by Le Piantagioni del Caffè S.r.l., are governed by the following General Terms and Conditions of Sale. The General Terms and Conditions of Sale are formulated in accordance with the provisions of Legislative Decree No. 206 of September 6, 2005 (Consumer Code) and any other applicable law.
Trade policy
Le Piantagioni del Caffè S.r.l., with registered office in Livorno, Via Provinciale Pisana 583/B, Livorno Chamber of Commerce Register of Companies, Tax Code and VAT Number 01579870492 (hereinafter Le Piantagioni del Caffè) offers its products for sale on its website www.lepiantagionidelcaffe.it/shop and carries out e-commerce activities exclusively with end users, understood as end consumers or natural persons acting for purposes unrelated to their business or professional activities, identified through the website www.lepiantagionidelcaffe.it/sho (hereinafter referred to as the Customer). In accordance with our commercial policy, we reserve the right not to process orders from parties other than Consumers or orders that do not comply with our aforementioned commercial policy.
For logistical reasons, Le Piantagioni del Caffè sells its products through the website www.lepiantagionidelcaffe.it/shop solely and exclusively within the territory of the Italian Republic, the Republic of San Marino, and Vatican City. Purchase requests with a delivery address outside Italian territory cannot be accepted or fulfilled by Le Piantagioni del Caffè.
By placing an order in the manner provided, the Customer declares that they have read all the information provided during the purchase process and fully accept the General Terms and Conditions of Sale. Le Piantagioni del Caffè reserves the right to change the General Terms and Conditions of Sale by giving notice on this page of the website. The applicable General Terms and Conditions of Sale are those in force at the time of placing an order. Any changes will be effective after publication on the website.
Registration on the website
Registration with a username and password is optional. If the Customer does not wish to register, they can still complete a purchase: only the data necessary for delivery and any invoicing of an order will be requested.
Product or service features and prices
Product images may not be perfectly representative of their characteristics but may differ in color, size, and accessories shown. All purchasing support information is to be understood as general information only and does not refer to the actual characteristics of a single product.
The products are offered at the price indicated on the website on the date the order is placed. Prices are inclusive of VAT, the amount of which will be specified on the purchase invoice for the product.
Prices do not include shipping and delivery costs, which are indicated in the final section before placing an order and specified in the order confirmation email sent to the Customer.
Order fulfillment
Orders are subject to minimum or maximum quantity restrictions and products are offered subject to stock availability.
Orders from persons under the age of majority will not be accepted.
The steps for placing an order and concluding the purchase contract are clearly highlighted in the sequence of pages on the website through explanatory texts and graphics.
Once payment has been confirmed, the order can no longer be canceled or modified.
Where applicable, promotional codes offered by Le Piantagioni del Caffè and its partners are valid only for the products and during the period indicated in each case. Promotional codes are non-refundable and cannot be combined. To take advantage of discounts and/or offers linked to promotional codes, you must enter the promotional code in the appropriate space when confirming your order on the website. If you forget to do so, your order cannot be canceled or renewed in order to take the promotional code into account.
Confirmation of receipt and acceptance of an order
Upon receiving an order, Le Piantagioni del Caffè will automatically send an email confirmation summarizing all the details of the order. After receiving an order, Le Piantagioni del Caffè will verify the availability of the product ordered and only after this verification will it communicate its acceptance of the order and the shipment of the product.
If Le Piantagioni del Caffè is unable to fulfill an order, it will promptly notify the Customer.
The customer shall have no right to compensation for damages or indemnification, nor shall Le Piantagioni del Caffè have any contractual or extra-contractual liability for direct or indirect damages to persons and/or property caused by the non-acceptance of an order.
Accepted payment methods
Le Piantagioni del Caffè accepts payment only through the following systems:
- Credit card (American Express, Visa, or Mastercard); through the Cartasi S.p.A. payment platform. The total amount of an order will only be charged when the products are actually shipped.
- PayPal: online payment system that allows any company or consumer with an email address to send and receive payments, subject to registration. Payment is made through the PayPal payment platform.
- Advance bank transfer: to the bank account held by Le Piantagioni del Caffè;
- Cash on delivery: payment will be made in cash to the express courier upon delivery.
Shipping of products
Le Piantagioni del Caffè will ship the purchased products exclusively to the destination specified in the order. We do not accept shipments to PO boxes.
Le Piantagioni del Caffè will ship the products ordered by the Customer via courier to the address provided by the Customer, approximately within 48 working hours of accepting the order. Delivery generally takes place within 5 working days. The times given for receipt of goods are indicative.
Delivery costs are invoiced on the basis of the rates indicated on the website on the date the order was placed.
The recipient of the goods is responsible for paying any taxes and customs duties required by the regulations in force in the territory of destination of the products.
The courier is responsible for delivery. Le Piantagioni del Caffè undertakes to collect any reports of non-delivery or delayed delivery of products through its website and, where appropriate, to assist the Customer in protecting their rights as required by law.
Acceptance of the product by the customer
Any damage to the packaging and/or product or any discrepancy in the number of packages or indications must be immediately reported by making a specific note on the delivery document. By signing the courier’s document, the Customer certifies the actual external integrity of the product and the conformity of the delivery.
Any problems relating to the actual physical integrity, correspondence, or completeness of the products received must be reported within 10 working days of delivery by sending an email to shop@lpdc.it or by calling 0586 429094.
Billing
An invoice will be issued for each order placed by private customers who have entered their tax code. The information provided by the customer when placing an order will be used to issue the invoice. No changes can be made to the invoice after it has been issued. When placing an order, customers must indicate if the shipping address is different from the billing address. If the private customer chooses not to enter their tax code, Le Piantagioni del Caffè will not issue an invoice or certify payment by issuing a receipt or tax receipt (Articles 22, paragraph 1 of Presidential Decree 633/72 and Article 2, letter oo) of Presidential Decree 696/96).
Right of withdrawal and return policy
In accordance with the provisions of Legislative Decree No. 21 of February 21, 2014, implementing Directive 2011/83/EU on consumer rights, the Customer may return the purchased product and obtain a refund of the purchase price actually paid.
The right of withdrawal may be exercised within 14 days of receipt of the product in the following manner:
Before the expiry of the aforementioned period, the Customer shall send a registered letter with return receipt to Le Piantagioni del Caffè or submit another explicit declaration to that effect. The communication may be sent, within the same period, by telegram or e-mail to shop@lpdc.it, or by telephone to 0586 429094.
The Customer will then be contacted by Le Piantagioni del Caffè to arrange for the return.
The product must be returned within 14 days of the date of receipt of the notice of withdrawal.
The refund of the price paid for the purchase of the product includes shipping costs.
If, for reasons attributable to the Customer, the value of the products has decreased due to handling other than that necessary to establish the nature, characteristics, and functioning of the products (for example: damaged products, products not properly or completely packaged, or products in which certain parts are missing or damaged, such as components, elements, accessories, packaging materials, boxes, documentation, and/or other items), Le Piantagioni del Caffè will refund the Customer the purchase price minus the value of said decrease. If the Customer returns products after the above deadline or in the case of opened and/or partially used products that cannot be returned, the right of withdrawal does not apply and Le Piantagioni del Caffè will return the purchased goods to the Customer, charging them for the shipping costs.
Subject to the above limitations, Le Piantagioni del Caffè will refund the amount actually paid by the Customer within 14 days of receiving the notice of withdrawal by crediting the bank account, PayPal account, credit card, or by check.
Warranty
All products, other than food products, sold by Le Piantagioni del Caffè are covered by the manufacturer’s standard warranty and a 24-month warranty for conformity defects pursuant to Legislative Decree 24/2002 and subsequent amendments and articles 130 and 132 of Legislative Decree 206/2005. To benefit from warranty assistance, the customer must keep the invoice or, if this does not exist, the transport document.
If the purchased product has manufacturing defects and/or has been damaged during transport, the Customer may request its replacement within 10 days of receipt by telegram, email to the following address shop@lpdc.it, or telephone call to 0586 429094. The Customer is also required to return the defective or damaged product in its original packaging, intact in all its parts.
In the event of product replacement, the shipping costs for the return shall be borne by Le Piantagioni del Caffè. Le Piantagioni del Caffè shall then replace the product with an identical one or, if stocks are exhausted and subject to agreement with the Customer, with one of equivalent value.
Applicable law and jurisdiction
The sale of products and/or provision of services takes place within the territory of the Italian State and is subject to the laws in force in the Italian Republic. The competent court for the resolution of any dispute shall be that provided for by Italian law in force at the time of conclusion of the contract.
